Abstract: 
This thesis entitled (The rule of woman's holding of judiciary in the light of contemporary developments) is a complement to a master's degree in jurisprudence in An-Najah National University, and included five chapters. Chapter one defined the concept of Justice, its meaning linguistically, in the Quran, Sunnah and the scholars, the chapter also dealt with the legitimacy of the judiciary, the rule of the judiciary for individual people, guardian, and the nation in General, indicating the importance of the judiciary, the researcher also listed some religious evidence which came at times to intimidate and to induce from judiciary at others. The study also contained a brief history about the nature of the judiciary through the previous ages; it discussed the Islamic judiciary in the Prophet Covenant, the reign of The Rightly Guided Caliphs, the Umayyad and Abbasids reign, and in the Ottoman period, in addition to the conditions of the judge in the Ottoman period. The study also included judge conditions according to the scholars and previous scholars, and reported in the third chapter the early and contemporary scholars conditions of the judge, in addition to the legitimacy of women's holding judiciary mentioning the statements of the early scholars in the legitimacy of women's holding of judiciary, as well as the evidences that each party relied on, also I presented in this chapter my own statements and opinions of these scholars. Chapter four included the changes that occurred in the present time, stating that there were changes in the nature of the judiciary currently, and there is also a change in the participation of women in public life. The thesis also contained in chapter five the latest contemporary scholars' statements in women's holding judiciary, explaining that some of the contemporary scholars allowed for women to hold a position in the judiciary, and other scholars who prevented women's holding a position in the judiciary, and I stated my opinion of the contemporary scholars statements in. the chapter also included in addition to the closing, all of the findings and recommendations of the study.
