Abstract:
This research is divided into four chapters; the first chapter is about Al-Fiqh views about traffic accidents for example accidents that are caused by animals and the consequences of such type of accidents, also knights and cars accidents. Furthermore, it talks about the suitable ways to benefit from roads. The second chapter includes the consequences of accidents “definition and Islam’s judgments” also the reasons and the conditions of accident’s consequences. It also talks about damages of accidents including its definition, types of damages especially the one could be compensated. In the third chapter, I talk about traffic accident’s financial compensation in Islam’s view through compensating accidents which cause deaths, injuries “body and face injuries” and body part’s cuts or by which it can’t be used again. Furthermore, compensating the car damages and Islamic scientist’s judgments about these conditions. The fourth chapter talks about the person who has the completed responsibility of the accident and compensating the other damaged side especially in the self-intendance accidents, also in which conditions should the family compensate the other part. This also includes the Islamic scientist’s views about its conditioned if he is dead or alive. I also include the types of insurance companies and if it’s compensations are prohibited or not. In addition, this chapter talks about the relation between punishment and compensation; e.g. if compensation is associated with punishment or not. I also talk about the traffic rules and it’s great roles in reducing the number of accidents and it’s damages on society, for that I attach some statistics which I bring from police service “accidents section” and finally the research comes out with conclusions, results and recommendations.
