Lawsuit for the separation of couples on the ground of absence and harm /comparative legal doctrinal study

Marige is one of Allah greatest methods in creating, and it is considered the only method, that Allah choose for giving birth, and continuation of life for ever, so the wisdom of Allah made man guiet different by his desires and ideas from other creachures without limitation , besides that contact male with femal in irregular way, made Allah put suitable system to keep dignity and honour. The stability of marriage is of the main objectives that islam strictly cares for, to make marrage relationship as one of the most sacred relationships among people, marrage contract is the best way to insure the continuity and an everlasting life, however, marrige life sometimes faces obsticals that prevent the mountinuety of this relation and achieving the goals such as perpetuating and satisfying the sextual need, which leads to some hatered and agrisson, and diverce usually is a right given to husband only, there for, Islam provided means, protection to the wife to keep away such agrission. This thesis includes a declaration for the right of the wife to ask for separation due to the absence and harm, This thesis also mentioned the practical prosicure from the begining the separation and what harm comes on, and showed the ways of proving it, and how to judge, and to show it is side effects and how to prove it is being incorrect.
