Abstract:
All praises to Allah and peace be upon his messenger ‘Mohammed’ his family and his friends, this dissertation talks about: the rule of both the Imams AlGhazale and Al-Ezz Ibn Abd AlSalam in the renewal of the interest definition in AShafee doctrine. It defined the sent interest, and it used the opinions of the original schools in the sent interest, as well as it illustrated the opinion of Ashafee doctrine about it.Then, it discussed the types of interests, and it talked about the restrictions on the sent interest and its conditions. After that, it talked about the opinion of the Imam AlGhazale in the sent interest, and the conditions of accepting this interest. Also, it talked about the divisions of this interest for the Imam AlGhazale, along with the examples given by this Imam. In addition, it compared the opinion of the Imam AlGhazale and Ashafee doctrine, and it concluded the additions that are added by the Imam Al-Ghazale in the topic of sent interest. Also, it talked about the opinion of the Imam Al-Ezz Ibn Abd ASalam in the sent interest, and the conditions he sat to accept work for this interest. Moreover, I transferred some of the examples that are illustrated by the Imam Al-Ezz Ibn Abd ASalam, in which he showed his opinion, in addition to comparing the opinions of both the Imam Al-Ezz Ibn Abd ASalam and Ashafee doctrine, and it concluded the conditions that are added by the Imam Al-Ezz on Ashafee doctrine. I also illustrated my opinion in some of the issues that are suggested during doing the research. It was shown to me after conducting this study that both the Imam AlGhazalee and AL-Ezz Ibn Abd ASalam, accepted the sent interest according to specific conditions, as they have a big contribution and a qualitative addition in adding the interest to Ashafee doctrine in its new dress.
