Abstract: 
Praise be to God and prayer and peace be upon the honest messenger: Mohammad peace be upon him. This research discussed the subject Orphan's rights in the Islamic philology (Fekh it focused on how Islam cared about orphans in the past and now and how it protects their concrete, moral, personal and civic rights, and raises them in morals, develops their abilities by raising them to be able to help their nation and not to be a heavy burden on it. Islam insists on taking care of orphans and forbids aggression on their rights in any way. These rights are: The rights concerning birth and they are divided into two parts, the first part: the rights before birth when he/she is fetus in his/her mother's uterus like the right of heritage, will, etc, the second part: the rights after birth like giving him/her a good name, Alaqeeqa , Altahneek etc. These rights are necessary for every child but they are more necessary for the orphan child because of his/her loneliness, disability to take care of himself. There are other rights like the rights of life, descent, suckling, breeding, trusteeship, bail, financial rights, right of mercy, love, education, play and other rights, which I talked about in this research. I compared between the Islamic law, which regarded the rights of the child before the 14th century, and the international agreements of of the child's rights. The result of comparison was that the Islamic law is better because it didn't consider these rights slogans like the international agreements but it applied them in real life and penalized everyone who goes against these rights.
