Modern Killing Means; Forms and Sorts An Authentic Legislativ Comparative Studye

This research which is entitled “Modern Killing Means; Forms and Sorts: An Authentic Legislative Comparative Study” is conducted in partial fulfillment of the requirement of the Master Degree in the School of Graduated Studies- Legislation and Jurisprudence Dept. The research is supervised by: Associated Prof. Jamal Al Kilani. The research includes an introduction and six chapters in addition to a conclusion. In the first chapter I identified the title, clarified its concept, moreover I explored killing sorts, its rules, regulations and penalty. In the second chapter I tackled the concept of killing by omission, I identified it then I explored its old forms and then I explored legislators’ points of view with regard to it. At the end of this chapter I mentioned the modern forms of killing by omission and the kind of killing in each sort. In chapter three I explored the concept of moral killing in which I identified it and mentioned its old forms and then I explored the modern moral killing in which I spoke of the sorts like the hidden camera, terrifying people, merry land, and April lie in which I identified the sort of killing in each former form. In chapter four I reviewed killing by modern vehicles and sports games. I identified traffic laws in which I explored its legitimacy, and different modern killing forms and sorts. In chapter five I pointed out killing by medicine and drugs, smoking, spoiled and poisoned food, pesticides, remnants of civil industries, gas, cool and plants. I then reviewed modern killing forms in all former means and I identified the killing kind in each one. In chapter six I explored killing by modern weapons and other means in which I pointed out killing by light and heavy weapons, and mass destruction weapons, in addition to the killing by electricity, job injuries, military industries, and fatal diseases in which I pointed out the killing sort in all former forms. I ended the research with a conclusion which included the most important results and recommendations including the following: 1-Killing by omission (not to aid the needy) is considered one of the killing sorts in Islamic Law. 2-Traffic law is legitimate and it must be implemented and people should be obliged to it. 3-Killing as a result of intended omission and not giving aid to the needy or not abiding by laws and regulations is considered some sorts of semi intentional killing. 4. Killing by all the means which I pointed out in the research includes the modern forms of killing which covers the three sorts of killing which are: Intended killing, semi intended killing and manslaughter. Finally I had the following recommendations:-Revising the imposed penal code in condition that each murder has its suitable penalty. The importance of the implementation of penalty in manslaughter
