Abstract:
This study aims at tracing and investigating the various jurisprudence rules of retribution, a punishment which is both retributive and compensatory for homicide and injury to humans and/or below. The researcher has meant to figure out and interpret eleven principal jurisprudence rules related to retribution due to its great significance for many Islamic jurists and scholars who used them as proofs for many related issues and concerns. This research is divided into four chapters in addition to an introduction and a conclusion. The first chapter discusses the jurisprudence rules that confirm retribution and highlight the impact of limitation on it. In the second chapter, the researcher explains, in details, the rules concerning the suspicions that hinder or lessen retribution as well as other similar concerns. The jurisprudence rules related to matters that entail, necessitate and encompass retribution are adequately shown in the third chapter. The last chapter is dedicated to a thorough discussion of the various rules that are effective or applied in retribution and forgiveness as well. All the rules, shown in the study, have some common denominators such as: interpreting terms and expressions of the rules, identifying the overall meaning and connotation of the rules, tracing their origins, proofs and coinage, and listing some relevant issues or rules that explain them thoroughly. The rules, discussed, are listed according to the given topics of retribution; they are comprehensive, dealing with most issues and sub-issues of retribution figured out by Muslim jurists so that, in the end, they become a reference to be consulted by interested people. May God be the ultimate Guide to the straight path!
