Abstract:
The subject of this study is Islamic Banks in Palestine and the extent to which they are committed to the standards of Baya' Al-Murabaha ( cost- plus sale under Sharia'a or Islamic Law). The study also defines the concept of Islamic Banks and tries to limit the date of their establishment. It focuses on these banks' most important transactions. Obviously, Baya' Al-Murabaha is the financing formula that is the most applicable in these banks. Next, I have defined Baya' Al-Murabaha, its types and the Jurisprudential disagreement about it. Additionally, I have clarified the forensic standards relevant to Baya' Al-Murabaha for clients which is stated under Standard No. (8). Then I explained these standards . Also, I have studied the some of the deals of Baya' Al-Murabaha in some Islamic Banks such as The Islamic Bank of Palestine, and The Arab Islamic Bank. I have noticed that these banks abide by these standards with some forensic violations. Such violations include lack of uncertainty about the amount of goods which the bank receives from the seller and keeping these goods with the seller to the bank till the client takes them. Another violation is lack of certainty that the client has received the goods and thus burdening the customer with insurance and financial transfer costs especially with outer transactions. Another pitfall is holding the client responsible in case the goods are damaged during shipment . finally, I have clarified the role of censorship bodies and I put forward some suggestions. Find and result in a statement of Islamic banks results, and Sharia Supervisory bodies, and dealers sell Murabaha, which enables them to know to sell Murabaha to buy something proper procedures
