Abstract: 
This study addressed the issue of the effect of the cancellation of the death penalty on the phenomenon of crime in the West Bank, the researcher has addressed in the study of the phenomenon of crime in terms of social, legal and ethical concepts. It also addressed the social, economic and psychological motivations of crime; the study included the interpreted social theories of criminal behavior, as the theory of social learning and social bonds and the theory of stigma and Alanomi, as well as the psychological theories like the theory of psychological analysis, the theory of personal and the theory of the Alsikobatah personality. The study also addressed in its second chapter the death penalty in the West Bank, where it explained the concept of punishment, characteristics and its theories as the theory of deterrence and the theory of rational choice, it also dealt with the death penalty in the Palestinian laws in the West Bank and Gaza Strip, and in some Arab and Western countries and in international conventions, and the study addressed the supporting and opposition trends of the death penalty, and the affecting factors in the cancellation or retention of the death penalty, and in the third Chapter it addressed an applicable chapter to determine the effect of the cancellation of the death penalty on the phenomenon of crime in the West bank from the prospective of lawyers in Jenin.. The study concluded many of the results, most notably is the impact of the cancellation of the death penalty on the increasing size and type of crime in the West Bank, and the Palestinian legislation suffers from negative aspects with regard to the frequent number of crimes punishable by death penalty, and the study concluded that the social, moral and religious development contributes in canceling or retaining the death penalty, and the public opinion contributes in identifying it.. The study recommended the need to re-apply the death penalty and limiting the crimes punishable by the death penalty to a narrower range related to the safety and security of the community, and it also recommended the need for greater guarantees for the accused individuals of crimes punishable by death, as the study recommended more studies and researches and conferences on the death penalty.
