Guarantee Letter of Islamic Banks

All the praise and thanks be to Allah, the lord of the ‘Alamin’, and peace be upon the Master the Messengers and all people ‘Mohammad Ibn Abed-Allah and his followers till the Dooms Day. This is an introduction presented by the student “Sulaiman Ahmad Mohammad AL-Qirim” under the supervision of Dr.Abed-ElMuni’m Jaber Abu-Qahooq, the lecturer at the faculty of Religion, An-Najah National University Nablus. This aims at having the Master degree in Islamic legislation, Department of legislation and jurisprudence 2003AD, 1424 AH. This introduction aims of presenting the concept of guarantee letter as it is done in Islamic Banks, giving Islamic judgment concerning of, because Islamic Banks are always accused of their commitment to Islamic legislation in dealing with their customers. This introduction contains an introductory chapter and five main chapters. In the introductory chapters, I talked many issues, Financial guarantee in the Islamic legislation, the definition of guarantee linguistically and conceptually, guarantee legitimacy, reasons, divisions and its basics. In the first chapter, (the concept of guarantee letter including topics) which comprises, warranty and guarantee; their meaning, basics, requirements and their consequences. I talked about the meaning of guarantee letter, the religion adaptation towards it, its relationship with warranty and guarantee about the concept of Islamic Banks. In the second chapter (guarantee letter a contract including topics) which tackles new ideas in contracts in Islamic religion, the way of issuing the guarantee letter and its basics. In the third chapter (kinds of guarantee letter and its judgment according legitimacy including topics). I talked about the two kinds of guarantee letter, the basic and final. This chapter includes guarantee letter in return for paying for the expenses of the project or auction and guarantee letter concerning receipt guarantee. In the fourth chapter, (payment for issuing guarantee letter including the following topics) where Iii pointed out the religion attitude towards payment, the judgment for talking payment for guarantee letter, I also compared between guarantee letters in both Islamic and traditional banks. In the fifth chapter, (the importance of guarantee letter in development including tow topics). In this chapter I wrote about investment its concept, judgment, requirements, the effect of guarantee letters in personal and general investment. Then I finalized by special appendix of legal opinion concerning guarantee letters. Then I ended by the conclusion composed of the most important results of the research and recommendations.
