Abstract:
In this research, the researcher addressed the definition of Diya in language and dictionary, the related terms, its legitimacy in the Quran, Sunnah and according to the majority of Muslims, as well as the purpose behind it and its provisions with respect to conditions and reasons. In the study, the researcher also explained the basis according to which Diya is estimated and the amount set for both sexes. Moreover, he talked about the definition of estimation in language and dictionary and explained its legitimacy. Then, he estimated the Diya for the Muslim male covering camels, gold, silver, cows, goats and jewelry in the Jordanian Dinar. Following that, the researcher explained the Diya set for the Muslim woman. The researcher concluded this study by talking about the person who pays the Diya. He started by describing Al-Aqila (Parental relatives who pay the Diya) that bears the Diya in case of manslaughter and semi intentional murder. The researcher also described how scholars disagreed on how to determine the Al-Aqila and explained the different characteristics of Al-Aqila, its contribution to Diya and the amount required from each person. Then, he talked about the insurance companies, their types, the opinions of Islamic scholars regarding what is Halal and what is Haram with respect to these companies’ work, as well as the provision of taking Diya from them. Additionally, the researcher discussed tribal reconciliation and its role in blood-related issues.
