Abstract: 
This paper tackled the significance of marriage, the basis of choosing spouses in Islam, the moral behind marriage and the importance of the medical test and its legitimacy. It tackled the defects of marriage and their effects on marriage contracts; it also talked about their types that might lead to divorce. In addition, it crystallized the injunction of the law on the issue of the separation of the spouses due to those defects and the aftermath of such separation. This study started by talking about the mental and psychiatric disease and their kinds, and their influence on marital life. Furthermore, it talked about the influence of such disease on marriage contract in the Islamic doctrine, the domestic relations laws in force in the Palestinian religious courts in the West Bank in case there is any psychiatric or mental disease. Then, it talked about chronic diseases and their kinds, and their influence on marital life. Furthermore, it talked about the influence of such disease on marriage contract in the Islamic doctrine, the domestic relations laws in force in the Palestinian religious courts in the West Bank in case there is any infectious disease. Finally, researcher concluded this study by talking about non-infectious diseases and their kinds, and their influence on marital life. Furthermore, it talked about the influence of such disease on marriage contract in the Islamic doctrine, the domestic relations laws in force in the Palestinian religious courts in the West Bank in case there is any non-infectious disease.
