Abstract: 
Thank God, prayer and peace be upon the Messenger of Allah and his family and companions. This study aims to identify the legitimacy of the fighting in repelling the aggression and control of the enemy in order to call for Islam and the prevalence of security and tranquility and commitment to the ethics of Islam during wars. This study includes the need to adhere to the Legitimate provisions concerning the lives of unarmed civilians, children, women, the elderly, and others who cannot participate in the fighting and acts of hostility against Muslims. In addition to the use of machinery of war and their provisions in Islam. It also concerns the situation of civilians of civilians in case they are captured by Muslims in the fighting. So, Imam chooses between killing or slavery or ransom payment, depending on the best interests of the Muslims Consistent with the spirit of Islamic Sharia. Finally the study includes the status of the enemy real estates and movable properties, and open lands either during war or after war.
