Maternity provisions in Islamic jurisprudence Parentage, pregnancy, lactation and nursery"

This thesis is about the concept of motherhood, and the related provisions in terms of the proven of parentage, pregnancy, lactation and nursery. It has been singled out a chapter for each side in this letter to be composed of four chapters and preface. The preface is talking about the mother and the great prestige that honor by the Great Allah, and the serious job entrusted to her. The First Chapter discussed what related to prove parentage, types of procreation and the extent of proven parentage, especially the modern ways such as cloning, which is illegal in Sharia, IVF, and the other ways such as smuggling semen from Israeli prisons. The Second Chapter discussed the concept of pregnancy and legitimacy and the provisions relating to it in term of pregnant work out of her house, breast-feeding and medicine. It shows that the priority is to the mother. It also discussed the abortion and that it is allowed only in limited cases such as if the woman has been raped or if there is a malformation in the fetus but that should be before 120 days of pregnancy. The third chapter talked about the concept of lactation and its legitimacy, its rule, provisions of the spending on the breast-feeding mother, the provisions of the hired wet-nurse, the issue of the young breast-feed and milk banks. It shows that the young breast-feeding is a limited permission for the one whom the prophet has given. The fourth Chapter discussed the concept of nursery, it's rule, the extent of applying it, the terms, invalidating and the nursery cost. The thesis concluded the necessary of attention to this side of jurisprudence, because of the negative sides of in ignoring it affect the mother in the community. Also it concluded to the necessity of searching in the emerging and cooperation between religion and worldly scientists to reach accurate results with regard to those issues, the awareness of public of the achievements of the jurists of ruling in order to rise the ignorance and injustice and to people to be aware of their issue.
