This research aims mainly at exploring the legal status of Hamas movement in Palestine as a political movement. It was founded 1987 when the Intifada erupted in December 9,1987 in both the West Bank and Gaza strip against Israel's occupation. The research sheds light on Hamas as part of the Palestinian national liberation movement and resistance against occupation. It points out that Hamas represents the religious sector of the Palestinians of the occupied territories. Furthermore, it discusses the right of self - determination of the Palestinian people and all other inherent rights collateral to this right. It shows the legal rights and obligations of Hamas under both public international law and international humanitarian law.
